Zoning and Land Use

As the primary RCO (Registered Community Organization) for the neighborhood EMAN plays an important role in Zoning and Land Use issues in our community, helping to regulate development and allow neighbors a channel through which to express their positions.

When a new development is proposed, or a property owner wants to make a physical change to a property that is not in compliance with the Zoning Code, a variance must be obtained from the ZBA (Zoning Board of Adjustment). Near neighbors need a voice in these proposals, and the variance applicant contacts EMAN to set up a required public community meeting, at which neighbors can get more information about the proposed changes, have an open discussion, and vote whether to support the project or not.

EMAN facilitates these meetings, and sends a written report to the ZBA, stating the vote of the near neighbors and the reasons for their decision. These reports are considered by the ZBA when they decide whether to grant a variance.

EMAN Community Zoning meetings are generally held on the third Monday evening of the month, unless there are no variance requests to consider. Meetings are held at the Mt. Airy USA conference room (2nd floor, 6703 Germantown Ave., at intersection with Phil Ellena St., entrance from rear parking lot)

• April 16, 2018, 7:30 PM (Variance case for 1326 E. Duval St., to allow the owner to use it as a 2-family dwelling. This case is continued from the March meeting.)
